OFFICIAL CONTEST RULES    

Introduction

By entering into the Sumner Center LLC’s “Win a Kansas Wedding – At the Edwin Smith House and Sumner Center” (the “Contest”), the participants (“Participants”) agree to abide by these Official Contest Rules and the decisions of Sumner Center LLC (“Promoter”, “we” or “us”), such decisions which are final and binding in all respects.

No purchase necessary to enter or win. Purchase of Promoter’s products or services will not improve your chances of winning.

THE CONTEST IS NOT A SWEEPSTAKES OR RANDOM DRAWING! The thought and effort that Participants put into their response may impact their chances of winning the Contest.  Touring the Sumner Center or the Edwin Smith House grounds are neither necessary to win, nor will doing so improve your changes of winning.  No purchase is necessary to enter the Contest.

Objectives

The Promoter’s objectives in conducting the Contest (“Objectives”) include:

  • Demonstrating the integrated use of the Sumner Center and Edwin Smith House together for events.
  • Bringing greater publicity and attention to downtown Wellington, Kansas, Sumner County, Kansas and the State of Kansas.
  • Advancing ongoing economic redevelopment within the City of Wellington’s downtown historic district, that is consistent with the requisite preservation of the district’s character.
  • Promoting travel and tourism in and to the local area.

The Promoter retains complete discretion over the suitability of any Entry or Entries in advancing its objects.  Participants have no right of appeal whatsoever with respect to an adverse determination by Promoter or its Judges (defined below).

Prize

The Prize involves Participants use of the following real and personal property for the conduct of the Prize Event (defined below):

  • the side (approximately 2,600 SF) and back yard (approximately 900 SF) at the Edwin A Smith House, 114 S Jefferson Ave, Wellington Kansas, together with 20’x40’ Tent and folding chairs provided for up to four (4) hours,
  • the first floor event venue at the Sumner Center located at 101-103 S Washington Ave, Wellington, Kansas, with folding tables (no linen service) and chairs for up to Three Hundred Fifty (350) guests for event duration of up to Six Hours (6), accompanied by Three (3) Hours each of the day prior to, and the day following the Event, for any decoration or set up/take down by family/friends;

along with an event insurance policy for Promoter’s benefit (altogether the “Prize”).

The events conducted by those Participants that are awarded the Prize are referred to as the “Prize Events”. The Prize does not include any product or service that the Participants require for the Prize Events not specifically identified as a part of the “Prize”.

The use of the two locations for the Prize Events may be either both on the same date, or on consecutive days (altogether the “Event Date”).  The Event Date will be the calendar date(s) that is/are either: (a) selected by us from among the up to three (3) preferences identified by Participants on the Entry Form, or (b) if left blank, a date mutually acceptable to Promoter and Participants,

The Promoter regards the Retail Value of the Prize as an amount up to Seven Thousand ($7,000) Dollars, depending upon the attendance and dates selected.  The Promoter, may, it its sole discretion, allow additional in-kind and/or financial sponsors to contribute to the Prize, in which case the Rules will be amended to reflect any additional terms and conditions. 

Eligibility

The Contest is open solely to any two (2) legal residents of the fifty (50) United States and the District of Columbia who are (a) each 18 years of age or older at the time of Entry Form (defined below) submission, (b) not currently married, and (c) wish to use the Prize to celebrate their marriage (without regard to whether the Participants are same sex or opposite sex couple).

Employees, officers, directors, or agents of Promoter or any of Promoter’s partners, related companies, agencies, or agents, as well as the immediate family (defined as spouse, parents, siblings, children, and grandparents) and same household members of any such employee, officer, director, or agent, are not eligible to participate.

Eligibility is at the exclusive discretion of Promoter, and Promoter shall be entitled to reject any entrant for any reason or no reason at all without having to provide an explanation.

All applicable federal, state, and local laws and regulations apply. Void where prohibited or restricted by law.

How to Enter

Eligible Entries may be submitted beginning on July 7th at 8am Central Time and must be received by August 31st 11:59pm. Eligible Entries require both a completed Entry Form and a Required Participant Photo.   There are two alternative methods for submitting the completed Entry Form and two alternative options for taking or creating a Required Participant Photo showing the Participants together in front of the Edwin Smith House.

Promoter will not consider incorrect, fraudulent, incomplete, late, sarcastic, or otherwise non-conforming entries or entries that are intended to annoy, abuse, threaten, or harass any person or entity in any way. Limit of one (1) Entry Form per Participant; multiple entries by any one individual or couple are void. Entries generated by macro, script, or other automated means are void. Entries generated by robotic, macro, script, or other automated means are void. Any entrant using fraudulent means to participate in the Contest will be disqualified and may be guilty of violating applicable criminal laws. Promoter reserves the right, in its sole discretion, to cancel, suspend, or terminate the Contest for any reason and without prior notice to any Participants. In such instance, Promoter may, if and as appropriate, select a winner using reasonable means that are materially consistent with the Contest. Promoter reserves any and all other legal rights and remedies, inclusive of injunctive relief, with respect to any person or persons who act to interfere with the Contest.

Fill in the Entry Form at www.sumner.center/winakswedding/entryform and upload a jpeg file version of the Required Participant Photo file where indicated.

Print and complete the pdf version of the Entry Form available for download at www.sumner.center/winaksweddingentryform  Return the completed Entry Form with the Required Participant Photo printed in a 5”x7” format through postal mail to the address shown below.

(Please note that the submission methods cannot be combined – if an Entry Form is submitted electronically then the Required Participant Photo must be uploaded, not set by postal mail.  Conversely, if the Entry Form is submitted by postal mail, the Requited Participant Photo must also be included, and may not be separately uploaded electronically.)

Creating the Required Participant Photo -Option 1

Entry photos may be taken in front of the Edwin Smith House by prior arrangement under our supervision. Please note photos obtained during trepassing will be deemed ineligible.  In the past trespassing and vandalism have been issues. As a result, we will only consider entries that where the required elements reflect the conduct that we wish to encourage. [Please also note, that if you wish to be accompanied by a professional photographer, that party must provide a Certificate of Liability Insurance naming us and our landlord as additional insureds, such insurance to be primary, and non-contributory with a waiver of subrogation.

Creating the Required Participant Photo – Option 2

The Required Participant Photo may be created through overlaying a photo of the Participants on a background of the Edwin Smith House, available for download at www.sumner.center/winaksweddingbackgrond  There are a variety of free tools available for overlaying the Required Participant Photo. Please note that the downloaded background image may not be used for other purposes.

Provision of Materials and Information/Intellectual Property

The contents of all Entry Forms (inclusive of photographs), once provided, are Promoter’s sole and exclusive property. By entering into the Contest, Participants represent, warrant and covenant that: (a) that they fully own whatever materials or information they submit in connection with the Contest; (b) they can make such submissions without violating any applicable law, agreement with any third-party, and/or third-party right of any kind (including without limitation any intellectual property, data protection, privacy, or publicity right); (c) each Participant has the full and complete authority of their co-Participant to submit the Entry Form, as-attorney in fact, and (d) that any and all materials or information provided by them shall be true and correct in all respects.

Promoter shall have the irrevocable, transferable, right (but not the obligation) to exploit any and all such materials or information in any manner it so elects to promote the Contest, its business, brand, products, and/or services, throughout the world in perpetuity, and in any and all media, now or hereafter known and license others to do the same. Without limiting the foregoing, Promoter may contract for certain product placements in connection with any element of the Prize provided.

Publicity

Participants

Subject to applicable law, entrance in the Contest constitutes Participants’ consent to Promoter and Promoter’s affiliates, agents and licensees to use the Participants’ names, voice, likeness, opinions, and biographical information for marketing, advertising, and publicity purposes in any media throughout the world at any time without the obligation to seek consent or to provide Participants with any payment or other form of consideration. Participants agrees to execute any supplemental documentation that Promoter reasonably requires to effectuate the terms hereof and failure to do so shall give rise to Promoter’s right to execute any and all such documents as Participant’s attorney-in-fact, which right shall be coupled with an interest and therefore, irrevocable.

Guests

Participants’ understand the Guests must consent to publicity associated with their attendance and related activities at the Prize Event, and undertake to cooperate with Promoter in documenting, the consent of Guests names, likeness and voice obtained by Promoter in documenting the Prize Event.

Non-Disparagement

Participants represent, warrant and covenant that neither they, nor their Guests will take any action, or refrain from taking any action, that disparages the Promoter, or any of its officers, employees, agents or affiliates.

No Conflicting Agreements or Commercial Promotion Outside of the Contest

The goodwill associated with the Contest belongs to Promoter, its successors, assigns and licensees alone. Participants represent, warrant and covenant that they have not, and will not, enter into any agreement or arrangement with a person or entity seeking to promote a product or service through the Contest, or the publicity resulting from involvement in the Contest. Participants provision of the contents of their Entry Forms, or similar information to a commercial entity seeking to exploit Participants entry in the Contest or the conduct of Prize Event is strictly prohibited.  Guests will be advised of a prohibition against wearing attire, or carrying signage that overtly displays any brand not previously authorized by Promoter in writing.  Participants agree to provide any and all third-party vendors contracted by them in the event of an Award with Promoter’s notice to that effect. Participants shall refer any news, media or entertainment industry inquiries regarding Participants involvement in the Contest to Promoter.  Participants represent and warrant that neither they, nor any immediate family member, are except as prominently disclosed in the Entry Form party to any talent, option or representation agreement.  The provisions of this paragraph in no way limit the liability of any third party for attempted or actual misappropriation of goodwill associated with the Contest and the Prize Event, or the involvement of Participants or Guests in the same. Without limiting the foregoing, third-party vendors are prohibited from exploiting for marketing purposes the use of any of their product or services in a Prize Event.

Review and Selection; Prizes; Notifying Prize Winners

A review of Entries by Promoter will occur on a rolling basis as they are received and will continue through Conest close for issues of eligibility. The Entries will then be provided to three (3) non-employee judges selected by Promoter who have no operational knowledge of either the Sumner Center, or the Edwin Smith House properties from the standpoint of any email or telephone inquiries as to rental, the identities of who may have toured one or both properties or who may have booked a rental of one or both properties (the “Judges”). The Judges will review the Entries for approximately two (2) weeks before making a recommendation to Promoter of a winning set of Participants (the “Winners”) from among all eligible Entries, or a ranked set of recommendations. Upon recommendation of its Judges Promoter may request that two or more sets of Participants participate in a remote interview administered by Promoter and attended by the Judges in connection with narrowing or final selection. Promoter expects to make an announcement of the Winner no later than September 30th, 2026. Odds of winning depend in part on the number of entries received, in addition to the Judges’ assessment of the alignment of the content of Entry Forms to the Objectives.

The potential Winners will be notified by email and/or telephone and must each sign and return Promoter’s Affidavit of Eligibility and Release within seven (7) days’ following the effective date of Promoter’s prize notification (the “Notification”). Failure to respond within the applicable time period will result in forfeiture of the Prize, and Promoter shall have the option to award the Prize to an alternate set of Winners. The return of the Notification or Prize as undeliverable may also result in disqualification and alternate Winners may be selected. Promoter is not responsible for digital communications that are undeliverable as a result of any filtering of any kind, insufficient space in a Participant’s account, or any other failure beyond its reasonable control. In the event of a dispute with respect to entries received from more than one user having the same e-mail address/account, the authorized subscriber of the account in question at the time of entry will be deemed the proper entrant. Potential Winners will also forfeit the Prize if the winner is disqualified as not eligible to have participated in the Contest in the first instance.

The Winners must show a government-issued photo identification to claim the Prize. All federal, state, and local income taxes resulting from acceptance of the Prize are the responsibility of Winner. Promoter reserves the right to substitute an alternate Prize of comparable or equal value in its sole discretion. Acceptance of the Prize also constitutes permission to Promoter to use the Winner’s name, likeness, and biographical information for marketing purposes (including posting the information on its website) without further compensation or right of approval, unless prohibited by law.

Subject to applicable law, the Prize is offered “as is” without any express or implied warranty of any kind or nature, including without limitation, any warranty respecting condition, merchantability, quality, title, or fitness for a particular purpose. Promoter is not responsible for replacing the Prize if the Event Date become undesirable to the Winners by reason of weather or any other claimed force majeure condition, change in circumstance, inconvenience other otherwise. The Promoter is not responsible for repairing damage to either structure unless such damage is caused by Promoter.

Participants’ Financial Responsibility for All Incidental Expenses

Participants are solely responsible for all incidental expenses that they and their Guests incur in connection with the Prize Event, and submission of any Entry.  In no event will Promoter reimburse Participants’, their Guests, or other vendors for any loss, cost, or expense associated with the Prize Event. In no event shall Participants either attempt to contract for any product or service on behalf of Promoter or represent to any third party that they have the capacity to do so.

Release and Indemnity

Subject to applicable law, by entering into the Contest and potentially receiving a Prize, each Participant agrees to release, discharge, indemnify and hold harmless Promoter, along with Promoter’s landlord and their respective employees, officers, directors, affiliates, partners, agents and assigns, from and against any claim, cause of action, demand, or proceeding (whether or not resulting from a breach of Participants representations and or warranties) (each, a “Claim”), and any resultant loss, injury (including death), cost, expense, fee, fine, penalty, or other loss or expense of any kind, including attorneys’ fees (each, a “Loss”), relating to or arising directly or indirectly out of the participation in a Contest (or related activity such as a press release), and/or Promoter’s right to exploit Participant’s name and/or likeness or fully exploit any other right granted to it hereunder, inclusive of those related to the involvement of Guests in the Prize Events, and/or from Participant’s receipt, use, or misuse of any Prize, no matter how such Claim or Loss arises (including without limitation, if arising out of any damage to a Participant’s computer system from downloading or using material from Promoter’s, or an affiliate of Promoter’s, website).

Limitation of Liability

IN NO EVENT WILL PROMOTER, AND/OR PROMOTER’S LANDLORD, OR THEIR RESPECTIVE LICENSEES, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, ASSIGNS, AFFILIATES, OR RELATED COMPANIES OR INDIVIDUALS SERVING AS JUDGES (COLLECTIVELY WITH PROMOTER, THE “PROMOTER PARTIES”), BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS) ARISING OUT OF ANY PARTICIPANT’S PARTICIPATION IN THE CONTEST, THESE OFFICIAL RULES, AND/OR ANY PARTICIPANT’S RECEIPT, USE, OR MISUSE OF A PRIZE, NO MATTER UNDER WHAT THEORY ARISING, EVEN IF ANY PROMOTER PARTY HAS BEEN ADVISED OF THE POSSIBLY OF SUCH DAMAGES. PROMOTER PARTIES’ ENTIRE LIABILITY WITH RESPECT TO: ANY PARTICIPANT’S PARTICIPATION IN THE CONTEST, THESE OFFICIAL RULES, AND/OR ANY PARTICIPANT’S RECEIPT OF A PRIZE SHALL BE LIMITED TO $500. SOME JURISDICTIONS MAY NOT ALLOW THE AFOREMENTIONED LIMITATIONS OR EXCLUSIONS OF LIABILITY AND AS SUCH, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Use of Collected Materials and Information

Promoter will be collecting, storing, and exploiting personal data about Participants to administer the Contest and exercise its rights hereunder, including without limitation, those relating to marketing and publicity. By entering into the Contest, Participants agree to Promoter’s collection and use of their personal information. By attending the Prize Event Winner’s Guests agree to Promoter’s collection and use of their personal information incidental to their participation in Prize Events. Promoter will not disclose any Participant’s personal information to any non-affiliated third party. Disposition of Deposits

In the event that the selected Winners have previously contracted with the Promoter to conduct an event at one or both of the Edwin Smith House and/or the Sumner Center, then upon the Promoter will return the deposit within ten (10) calendar days of the occurrence of the Prize Events.

Amendments

Promoter reserves the right to amend the Official Rules at any time, without notice to Participants. All Participants are deemed to have consented to any and all amendments to the Official Rules by continuing. A Participant may withdraw their Entry from the Contest at any time by sending an email to winawedding@sumner.center. Such withdrawal is the sole and exclusive remedy that any or all Particpants have as to any amendment or amendments that are not acceptable to them. Prior to processing the withdrawal of any Particpant the Promoter may seek confirmation, including by email or telephone call with each of the Participants listed on an Entry Form.

Dispute Resolution

The parties hereto acknowledge and agree as follows: (1) that all disputes, causes of action, and claims connected to or arising in any way hereunder between the parties shall be resolved solely on an individual basis (i.e., class actions suits are hereby waived by the parties), and exclusively by the state or federal courts situated in either Wyandotte County Kansas or Johnson County Kansas; (2) that the laws of the State of Kansas shall govern, without regard to its conflict of laws principles; (3) that the parties hereto waive any right to a trial by jury; and , and (4).no action may be commenced against Promoter or any Promoter Parties unless Promoter has received written notice of dispute by Certified Mail, Return Receipt Requested, with sufficient specificity as to allow Promoter to respond and has not provided a response or rebuttal thereto, within thirty (30) calendar days of  receipt.
